Where you download or purchase our digital products (including checklists, guides, ebooks, workbooks, video or audio content) (Digital Products) you are granted a non-exclusive, non-transferable, limited licence to access and use the Digital Products for your own personal use. You may not assign or transfer the Digital Products to any other person without our express written consent.  We reserve the right, in our sole discretion, to accept or refuse to provide the products and/or services to you at any time for any reason

 Except as otherwise provided, you acknowledge and agree that you have no right to modify, edit, copy, reproduce, create derivative works of, reverse engineer, alter, sell, create derivative works of, enhance or in any way exploit any of the Digital Products in any manner whatsoever except as authorised by us.

 PRIVACY

These Terms also include our Privacy Policy which sets out how we use your personal information, which can be accessed here.  By using this Site, you consent to the processing described in the Privacy Policy and warrant that all data provided by you is accurate.

 CREATING AN ACCOUNT

To place orders and access some features of the Site, you may have to register an account. This means you’ll have to give us accurate information including your name, your business name, address, a valid email address and telephone number and you must be at least 18 years old. You warrant that any information you provide during the account set up process is accurate and correct at the time you provide the information and that you’ll update information should there be any changes to the information provided. You’ll be solely responsible for the activity that occurs on your account (including orders placed on your account) so keep your account password secure.

We reserve the right to suspend or cancel your account at any time, at our sole discretion, if you breach any provision of the Terms or applicable law or where your conduct impacts our reputation.

 PRODUCTS

Many of our products are made from natural wood.  As with many natural products their imperfections are their charm and why we love them so much. Natural imperfections of wood products include, but are not limited to:

  • uneven colour texture and grain.
  • uneven absorption of stain and paint.
  • pin holes
  • knots

 Please read all labels on the products and information relating to the product on our website and use the products only as directed.  Adult supervision is required for all products from our website.

We do our best to ensure that the colours of any products are accurately displayed, please note, that on occasion the colour on our Site may seem different, depending on the device you use this can be for a number of reasons which are outside of our reasonable control, and may not accurately reflect the colour of the product.

 REFUNDS ON PHYSICAL PRODUCTS

For hygiene reasons, we are unable to offer refunds for change of mind if the bundle/kit seal sticker has been tampered with or removed. If you receive your order and change your mind before opening, please send us an email within 2 business days to guide@ninomondo.com with pictures to indicate that the box is still unopened. We will respond within 3 business days with return instructions. You agree to pay to all return courier costs including insurance and a 20% service fee. Returned items must be returned sealed, in all original packaging and in saleable condition. You agree to any costs being deducted from the refund amount.

If a product is faulty or damaged, we may be able to offer a replacement/refund for that product or offer a discount code instead for your next purchase. If your product is faulty or damaged, please email us photographs of the fault within 2 business days to guide@ninomondo.  We will respond within 3 business days to arrange a suitable way to make it up to you for the damage. Please note that where you purchase a bundle/kit of products from us, we do not offer a refund for the whole kit, but just the value of the product that is faulty.

Natural imperfections and imperfections associated with the natural appearance of the wood products are not considered a fault and therefore are not accepted as a reason for the replacement or refund of a product.

 DIGITAL PRODUCTS

Upon purchase of a downloadable product from this Site, you will receive an email with a link to complete the purchase of your product including, where applicable, a direct download for your product.

Products may be available on this Site without a need to purchase or download them.  You agree and accept full responsibility and risk for downloading and using these products.  You agree that you will indemnify and hold harmless, Nino Mondo and all our related entities and personnel, against liability for any harm or loss caused by the downloading and use of these products.

You agree that it is your responsibility to ensure that you have the appropriate programs and hardware available to access and use the downloadable products and that this is not a reason for which we can offer a refund.

 REFUNDS FOR ONLINE DIGITAL PRODUCTS

Due to the nature of digital products, any orders received and processed by us for digital products available to be purchased online have a strict NO REFUND/RETURN/EXCHANGE POLICY. Where we send the wrong digital product, we will send you the correct digital product and where the link provided to download is not working, we will send you the digital product direct or via a revised link at no extra cost.

  PREORDERS

Where a product is not yet available, or out of stock, you may, at our sole discretion, be able to pre-order the product.  You will need to accurately provide the information requested through the website and pay the part/full purchase price of the product to secure your pre-order unless specified as free pre-orders. You acknowledge and agree that we cannot guarantee the date that these pre-ordered products will be fulfilled, any dates which may appear on our website are indications/ estimates only.

Cancellation of Preorders

You may cancel your preorder and receive a full refund, less any transaction fees, at any time up until the preorder closure date.  Between the preorder closure date and the date on which the goods are shipped to you, you may, at our sole discretion, be eligible for a refund, however, such refunds will incur a fee representing 20% of the purchase price of the product pre-ordered.  Once pre-ordered goods are shipped they are subject to our usual refund policy.

 SHIPPING

Shipping details (whether free or charged) for products purchased on the Site will be displayed on the live website and are subject to change from time to time. We are only able to ship within Australia at this stage. International deliveries are possible where customs, duty, shipping and other charges are borne by the customer.

Orders will be dispatched and posted within 1-3 days.  Once posted, you will receive an email notification providing information to assist in tracking your order. Once the order is posted:

  • We do not take any responsibility for the products/ order being shipped
  • We do not have control over the time/ method of delivery.

 Disclaimer

Once a bundle has been delivered to your delivery address, we take no responsibility for any damage or theft that may occur. If you will not be present to accept delivery of your parcel or feel that your address is unsafe to leave a parcel unattended, we recommend sending your order to a work address.  Where you provide a work address, please always include the level (if a multi-storey building) and the name of the company, Sendle/ Australia Post will return to the sender if you do not make these details clear.  We can redeliver parcels where the address is incomplete or has been incorrectly provided, this will incur a delivery charge of $40 within Australia. 

Please note that the delivery times specified are approximated as provided by Sendle/ Australia Post, we cannot guarantee these delivery times.

 PRICES AND PAYMENT

All prices are in Australian Dollars (AUD) and are inclusive of any Australian Goods and Services Tax (GST) (as applicable). The prices indicated on the Site may change at any time without advance notice to you.  If you’ve purchased our products or services, it will be charged at the price in force at the time a customer’s order is validated.

We reserve the right at any time to modify or discontinue the product or service without notice at any time. We shall not be liable to you, or to a third party for any modification, price change, suspension or discontinuance of the product or service.

We may from time to time provide discounted products and/or services.  You may only use one discount code with each purchase. We reserve the right to reject or cancel any orders where you add more than one discount code.  We allow you to use discount codes strictly on the terms and conditions upon which they were issued which, amongst other things, may include terms relating to your eligibility to use them and a maximum order value.  Discount codes and/or vouchers cannot be used in conjunction with any other offer or promotion.
